In its effort to prevent the diversion of prescription pain medications into the illicit market, the DEA moved last month to bar two Florida CVS drug stores from selling the drugs. But on Wednesday, the US Court of Appeals for the District of Columbia ruled the agency had gone too far and temporary blocked the DEA's order.
The case is Holiday CVS LLC v. Eric Holder, No. 12-5072. The opinion is not yet available online, but should be shortly at the court's web site.

The New York Times reports of more financial woes for municipalities. Suffolk County will run $530 million into the red over the next three years and has declared a financial emergency. One of America’s busiest airports, Orlando Sanford International, has announced it will opt out of using TSA workers to screen passengers, a move which threatens the highly unpopular federal agency’s role in other airports across the nation.
“The president of the airport said Tuesday that he would apply again to use private operators to screen passengers, using federal standards and oversight,” reports the Miami Herald.

NEW ORLEANS (CN) - A key witness in the criminal investigation of police shootings after Hurricane Katrina sued New Orleans, its mayor, police chief and seven officers, claiming he was harassed and intimidated so severely he had to be put in the federal witness protection program.
Bernard Calloway sued the city and its officials for $2.5 million in Federal Court.

The Federal Reserve ran another "stress test" on major financial institutions and has determined that 15 of the 19 tested are safe, even in the most extreme circumstances: an unemployment rate of 13%, a 50% decline in stock prices, and a further 21% decline in housing prices.
