Texas Police Officer Indicted For Manslaughter


NORTH TEXAS (CBSDFW.COM) – A high-speed chase through the streets of North Texas ends with an officer shooting and killing a suspect. The officer involved could face up to 20 years in prison for what has now been deemed a crime.

In a rare move, a Dallas County Grand Jury has indicted Patrick Tuter, a former Garland police officer, for manslaughter. It was August of last year when Tuter fired 41 bullets at unarmed suspect Michael Vincent Allen.

It’s been three years since a police officer has been indicted for an on-duty shooting in Dallas County. Today’s action is only the second time in 17 years that an officer has been indicted.

24245 What kind of weapon was the cop using that could fire 41 rounds?Or did he stop,reload,and continue to fire?And how did he miss 20 times,not even miss the guy but the entire truck 20 times?

17094 Unless he unleashed on the suspect with a chain-fed machine gun, he would have had to have reloaded unless he was carrying at least 3 semi-autos filled to capacity.

Given that those details are not supplied, it's hard to say for certain, but... given a knowledge of what police will normally use in a normal pursuit that escalates to a shooting incident, its most likely that he would have had to have reloaded (switched clips) at least 3 times for a standard issue Glock 9mm or 45.

Manslaughter though? Considering that it appears that the cop reloaded 3 times before the shooting stopped, it seems a hell of a lot of information has been omitted from this report. If the suspect was unarmed, then the officer should be being charged with 2nd degree murder at the least (provided that the suspect died due to gun shot wounds). If the suspect *was* armed, and fired at the officer, or even lead the officer to believe that his life was in emmanent danger, then it's (likely) a justified shoot... but 41 times?

Q: The article says the officer fired 41 times. How many of those 41 shots hit the target/suspect?

Either way, he should be removed from the force, whether it's due to a bad aim, or getting overzealous.
