Judge Finds Cop Not Guilty of Assault after Refusing to Watch Video of Assault

A St. Louis cop is caught on video, slamming his forearm across the face of a handcuffed teenage suspect.

Rory Bruce not only gets fired for the incident that took place last year, but ended up charged with assault - something you rarely see happen.

However, when Bruce stepped in front of the judge to be tried this week, the judge refused to watch the video that came from a surveillance camera from the back of a police transport vehicle.

As a result, Judge Theresa Counts Burke found him not guilty.



Judge Burke refused to tell KMOV-TV why she did not want to watch the strongest piece of evidence in the case against the former cop.

But the head of the police union, Jeff Roorda, who is also a Missouri state representative, fully agreed with her decision not to view the video because he believes videos should only be used to protect police, not hold them accountable.

Roorda is now going to help Bruce get his job back.

According to KMOV-TV:
In an emailed statement, Circuit Attorney Jennifer Joyce said the office was disappointed that the judge didn't see this video--adding that the video clearly shows Bruce beating a handcuffed teen.

Judge Teresa Counts Burke didn't return calls for comment.

Roorda says the judge did right--he told News 4, police videos like these should be used to protect police.

Now, it's become a "gotcha-head hunter" tool that we've seen internal affairs go over-board with.

Roorda says--with his name clear in the courts--Bruce should get his job back. We'll stay on it to see if he does.

20138 Is there no accountability? Over and over we see "authorities" simply do something that makes no sense, and then...as if they were not public "servants" simply refuse to even justify, explain, or give any comment at all. This is not democracy.
The public, at least the people of St. Louis have a right to expect an answer.

The problem was that the video requires someone to testify to its authenticity. The kid wouldn't testify (claimed 5th Amendment Right...and I bet we can all guess why he was afraid to testify) and the other cop that was there said, paraphrased, "I didn't see nuttin' like that." Leaving no admissible evidence.

This is all on the cops; a blue wall presentation. The judge was left with no choice.

2414 The Judges are above the Law. They side with their BASE . People who support their campaigns. My Judge refused to look at proff of a million dollar acct. to support representation for me from a divorce that was " REVERSED and REMANDED " for retrial. Than we have the REPUBLICAN STATE'S ATTORNEY 'S off ice who told me that they will deal with the EMBEZZELMENT charges aginst my husband after I come in to answer questions on my voting record. Threat , I know so........Justice a bunch of thugs.

80202 678, that sounds totally wrong to me (I'm no lawyer though), this was a police video wa it not ? Seems like the chain of custody ought to be solid, and any honest cop, would have to testify the video was not manipulated, but raw video from their own cameras.

17444 This decision makes no sense assault is assault. Having someone testify to an assault videos authenticity is liberal lunacy. If this were a video of a civilian assaulting a police officer it would've been viewed. It just shows cops,judges, and prosecutors all are part of the same criminal club.

104129 Theresa counts-burke is morrally corrupt. I was plantiff pro se in her court against big business with objective evidence on paper. She refused to look at it, stopped me from mentioning the evidence and then proceeded "not to have evidence to rule in the case", ruled for both parties and then awarded her attorney friend his fees. The attorney of course was too smart to even attempt to collect his fees knowing the evidence didnt justify that rulling. Theresa counts-burk does not have the moral fortitude nor is she qualified to be anyone's judge.
