Smoking Banned Inside Santa Monica Residences

The city council voted 4-2 on Tuesday to expand a smoking prohibition in the coastal city

A 4-2 vote during Tuesday's city council meeting made Santa Monica's already restrictive smoking rules even tighter. New tenants of the coastal city will not be allowed to smoke in their residences unless they designate them smoking. Some residents say the ordinance goes too far but consumer protection groups say it's a step toward better public health.

Proposed residential smoking ban in Santa Monica fails
July 25, 2012 | 7:47 am

Santa Monica city leaders Tuesday night tabled a ban on residential smoking, citing unanswered questions about the proposed ordinance's effect on medical marijuana users and condominium owners.

The measure, which failed on a 4-2 City Council vote after passing 4-2 on its first reading, would have designated all new units in apartments and condominium complexes as non-smoking units.

Tenants, including medical marijuana smokers, who wanted to keep smoking in their homes would have had to disclose that to their landlords and get their units designated as smoking units, a stipulation one member of the council felt would violate tenants' privacy.

6752 If you're renting a place, I can see where you should designate the place smoking or not smoking. ...with allowable fines that go BACK TO THE OWNER OF THE RENTAL UNIT, not the greedy system.

Certainly, a place that has been smoked in is unhealthy by non-smoker standards. I thought the article was going to outline a resolution that banned them from smoking in their own houses. That would piss me off.

I now liive in a "smoke free city". You can't smoke in public places. I'm a non-smoker but I campaigned hard against that draconian ordinance! Its not the governments business if people want to smoke in a bar and the bar owner is OK with it.

71104 Some of these so-called "medical marijuana" users (I believe) are using it for recreational use and NOT for (so called) MEDICAL use. There is a tenant in my building that smokes marijuana and I end up having to close my sliding glass door (on a hot da y) so that the oder is not coming in my apartment. (of which) it usually does if I have my balcony or kitchen window open.
