Arizona Man Holding Air Rifle Killed in Drug Raid

Tempe, Arizona, police in the Special Investigations/Narcotics Unit serving a drug search warrant Wednesday afternoon shot and killed a man in his backyard as he held an air rifle. John Wheelihan, 43, becomes the 22nd person to die in US domestic drug law enforcement operations so far this year, and the sixth in the last month.

The victim appears to be a local photographer whose listed business address matches the address the police raided.

According to reports from local TV stations CBS 5 and ABC 15, citing police sources, police were executing a drug search warrant at Wheelihan's home on East Cairo Street when Wheelihan walked out the back door carrying a Whisper .22 caliber air rifle and began to approach detectives working the perimeter.

Tempe Police Sgt. Mike Pooley said Wheelihan raised his air rifle as he approached detectives, ignoring repeated demands to drop the weapon, so they shot him. He was taken to a local hospital, where he died of his wounds. No police were injured in the incident.

Police did not say whether they were serving a "no-knock" warrant, whether they were uniformed or undercover, or whether any drugs were discovered.

In the comments section of the ABC 15 story on the killing, posters who identified themselves as friends of Wheelihan were highly skeptical of the official story.

"I knew this man personally and so did many of my other friends/associates," wrote a poster identifying herself as Sandi Rollo. "This story is BS!!! If you didn't know him, keep your suspicions to yourself. Tempe Police fucked this one up. There is absolutely no way this man was suicidal and no way he did what they say he did. Dirty cops, dirty media."

Rollo pleaded for anyone who saw anything to step up. "If there are any eyewitnesses to this, please come forward," she wrote. "There is no way John would do this."

66142 Sorry, I can't find any evidence of wrong-doing in the article that says the police screwed up. They were at the right address. So a judge even agreed that the house could be searched. Strange the information was left out for why the cops were there. Then, the police report says the man approached them with a weapon and refused to stop or drop it. Cops don't have a super-tech device to tell you the calibre and type of weapon approaching you in the dark. So, they shot him. Until a witness comes forward to refute that story, anyone berating the police is just being a closed minded hater.

9822 66142, cops do have a super-tech device, actually a pair, to tell a pellet gun from a gunpowder propelled firearm. They are called eyes. If they are unable to differentiate between these devices they should study this issue before they resume patrol. If they could not see because of the darkness they have a lower-tech device known as a flashlight. These can be obtained at a myriad of locations and are quite useful for nighttime work.
The article states that a "Special Investigations/Narcotics" Unit was "serving a drug search warrant". That seems pretty clear cut to me.
The article doesn't mention if this raid occurred at night or in the daylight hours. I would wonder if it was carried out under cover of darkness why? Whatever tactical advantage the police obtain by busting in someone's door at night is surely more than morally nullified by the increased injury and loss of life that frequently goes along with these nighttime raids. Not so many years ago the police would have just picked him up at work, intercepted him at some point when he was out of the house or just went and knocked on the front door, after all this doesn't appear to be Bin Laden they were after.
The man probably realized there were people sneaking around in his backyard in the wee hours and went outside armed as best he could to confront the intruders. The natural reaction of a normal man is to investigate and protect his property and family. It is unlikely his intentions were to get into a firefight with the Narcotics Agency armed with only a pellet gun. It is highly probable that if the officers had been more clearly visible and easily identified he would have lain his pellet gun down, thereby negating any danger to the officers. Safety is what we're all about, because after all, everyone knows you can shoot your eye out with one of those things.
