Judge Tells Kokesh He Will Take His "Silence as Consent"

This is what passes for "consent" in Amerika:
Kokesh was handcuffed and in a wheelchair surrounded by 6 sheriff's deputies when he refused to reply to a judge's question on closed circuit TV. The question was "Are you Adam Kokesh?" The judge told Kokesh, "I will take your silence as consent" before ordering Kokesh held without bond. - WUSA9
"I will take your lack of consent as consent."

Sounds like the excuses of a rapist.

46105 I thought you had the right to remain silent on the ground that you might incriminate yourself?

Not anymore, everyone is a potential terrorist now. You don't have the right to remain silent, you do however have the right to be held with out a charge for as long as the state and its organizations think is reasonable.

The ruling comes in a case in which a suspect, Van Chester Thompkins, remained mostly silent for a three-hour police interrogation before implicating himself in a Jan. 10, 2000, murder in Southfield, Mich. He appealed his conviction, saying he had invoked his Miranda right to remain silent by remaining silent.

Kennedy, writing the decision for the court's conservatives, said that wasn't enough. "Thompkins did not say that he wanted to remain silent or that he did not want to talk to police," Kennedy said. "Had he made either of these simple, unambiguous statements, he would have invoked his 'right to cut off questioning.' Here he did neither, so he did not invoke his right to remain silent."

So I guess, this new step means that not only the suspect has to say that he remains silent, but he also has to do it fast enough.

13748 So then, according to these "justices", one must speak to remain silent and according to this local judge, anything you DON'T say will be considered a confession.

Only within the echoic cranium of a lawyer or "law enforcement officer" can this make sense.
