Cop Convicted Of Second-Degree Manslaughter For Shooting 5-Yr-Old Boy In Back Of Head Gets Record Expunged, Now Free Again To Become An Officer

Five year old Austin Haley was out fishing with his grandfather when police officer Paul Bradley Rogers shot his firearm in a failed attempt to kill a snake hiding in someone's birdhouse. The bullet passed through the birdhouse onto the Haley's property, with the first bullet the officer fired passing right between Austin's grandfather's legs and into their lake. Austin's grandfather then screamed out,"Stop, don't shoot! There’s someone down here!"

Six seconds later, officer Paul Bradley Rogers fired another shot, he again missed the snake, but the bullet struck five year old Austin in the back of the head, killing him.

The officer was found guilty of second-degree manslaughter, which is a violent felony, but he was given no jail time and instead was sentenced to perform some "community service with animals."

Now, thanks to what's being described as a "loophole," the officer just had his record expunged, which means he is now free again to become a police officer. reports:
In 2007, former police officer Paul Bradley Rogers and his former supervising officer, Robert Shawn Richardson, responded to a neighbor’s call about removing a snake from a birdhouse. The snake was believed to be poisonous, so Richardson told Rogers to shoot the snake, but Austin was struck in the process.

Rogers was later found guilty of second-degree manslaughter, and he and Richardson received deferred sentences.

Manslaughter is a violent crime that one would typically not receive a deferred sentence for, Austin’s mother, Renee Haley, said, but since the two received deferred sentences, one was able to get his record expunged through a loophole and, from her understanding, the supervision officer is trying to as well.

Haley said that the law was changed in November allowing a loophole that basically says if the person received a deferred sentence, their record can be expunged.

“Normally deferred sentences would be for much lesser crimes,” she said. “(This loophole) wasn’t meant for people who killed a little 5-year-old boy. It was meant for lesser crimes.”

Haley said they are only asking for fairness.

“If the roles were reversed and I had shot the gun, it would be much different. I would’ve been sent to jail and the sentence would have been done more harshly,” she said.

As it is, the two never served any jail time and were asked by the court to do some community service with animals, Haley said, adding that the only form of punishment they were really given was that this violent crime was going to stay on their record forever.
Forget what would have happened if it was a mother who mistakenly shot her own son, what would the punishment have been if it was a police officer who was mistakenly shot in the back of the head by someone trying to shoot a snake? Community service with animals?

There are two sets of rules in this country, those for the rulers, and those for the ruled.

5029 UnF-ing believable! The justice system has let down the Family of this deceased little boy. A family member or friend of the family should seek out their own form of "Justice" and eradicate the scumbag. Where are the MEN out there? - What man would let another man get away with killing his child/nephew/grandchild----------- A life time in prison - the death penalty would be worth the vengeance -- and would establish precedence.

The only way the tide is going to turn on the Police State is if we stop being prey and start being predators.

cops are most-definitely amongst the "ruled." i don't understand why they agree to be tools, or, perhaps, i just see how much better their lives could be, if they didn't work for the cartel.

18443 i'm less mad at the officer for his negligent mistake,
than i am at him for accepting this result of not going to prison, accepting being a convicted felon unable to ever again own a gun, and unable to ever again be a cop.
he should admonish himself, but it's obvious a person like him won't.

God still sees all this, he won't "escape".

nextly for the same reasons as above i'm equally furious at every person involved in not having the cop convicted of the felony and everything that goes with it.

again God sees all and none of them will escape His judgement.

that said, if it were my child i would not contain my fury, all listed above would be executed, and anyone coming after me afterwards would meet every ounce of battle i was capable of. i'm ready to go to God, none of these people are ready and they have no idea how intense their punishment from God will be. they've been given chances to repent and they scoff at it.

their days are coming, noone escapes God's judgement.

243 Anyone who knows anything about firearm safety can recognize the complete negligence demonstrated by this officer. Discharging a weapon with FMJ or HP ammunition to kill a snake in a birdhouse is one of the stupidest things I've ever heard of. There's a reason that the so aptly-named "snake shot" or "rat shot" exists. There's also a reason that animal control exists.

It is pathetic that this man has been granted the privilege to become an officer again.

presumably, you are a Christian? (the contradiction is the give-away); "thou shalt have no other gods before me, love thy neighbor, as you would yourself" - the 2 most greatest commandments.
so, if you're judgment supersedes Christ's judgment, you must be the messiah? read your bible carefully. you might figure out "who" those "other gods" are. (you might even figure out, "Christ's present location).

16217 Instead of using your big gun, did you not have a can of tear gas that you could of tossed in? A 5 year old child was murdered by a stupid cop. The family is in my prayers. The family needs to sue the city or county where he works for wrongful death.
